The Owner-Operator Work Permit/Visa allows foreign nationals who own and operate a business in Canada to engage in business activities. Types of Owner-Operator Work Permits
International Mobility Program
To qualify for an LMIA-based Owner-Operator Work Permit, a foreign national must:
- Own at least 50% of the business and hold a permanent position.
- Earn at least the median wage for the role.
- Operate a business that creates jobs and transfers skills to Canadians or permanent residents.
- Present a viable business plan with financing, office setup, and relevant expertise.
- Hire at least one Canadian or permanent resident within the first year.
This visa can provide up to 200 additional CRS points under Express Entry for senior managers, improving chances of selection.
International Mobility Program
To qualify for an Owner-Operator Work Permit under the International Mobility Program, a foreign national must:
- Own at least 50% of the business.
- Demonstrate the business’s potential to benefit Canada economically, socially, or culturally.
- Demonstrate the business’s viability by creating employment or offering unique services for Canadians or permanent residents while applying relevant expertise to ensure success.
- Manage all key business aspects and submit an Offer of Employment (Employer Compliance) to IRCC.
This permit allows foreign nationals to operate and control their own Canadian business while contributing to the economy and potentially gaining a pathway to permanent residency.
For an Owner-Operator Visa, if a foreign national owns less than 50% of the business, an LMIA is required.
Only one owner per company can obtain the visa. Applicants can temporarily operate a business in Canada or pursue permanent residency, but those with dual intent must convince immigration officers they will leave Canada after their stay.
